These Terms & Conditions apply to all photography services, bookings, reservations, and online purchases made through this website or directly with the photographer. By completing a booking or payment, the client agrees to all terms listed below.

1. General Information

  • All photography services provided by Kemal Onur Özman are subject to availability and confirmed only after payment of the booking deposit.

  • The service is considered a photography session, not a physical product.

  • Communication regarding bookings must be made via email, WhatsApp, or direct message through official contact channels.

2. Bookings & Payments

  1. A booking is confirmed once the required deposit (down payment) is paid by the client.

  2. Remaining balance is paid on the day of the session, unless otherwise agreed in writing.

  3. Accepted payment methods include bank transfer, credit/debit card, and cash.

  4. All deposits are linked to the specific date and time selected during booking.

3. Deposit, Cancellation & Refund Policy

  1. Cancellations More Than 14 Days Before the Session

    • Clients may cancel their booking entirely.

    • The deposit will be refunded minus credit card fees, payment system fees, and transaction charges.

    • Refund is processed to the original payment method.

  2. Cancellations Between 14 and 7 Days Before the Session

    • The deposit becomes non-refundable, but will be issued as an open-date voucher for future use.

    • The voucher can be used for any upcoming available date and is valid for future photography sessions.

  3. Cancellations Within the Last 7 Days

    • The deposit is non-refundable.

    • No voucher is issued unless the photographer approves an exception.

  4. No-Show

    • Failure to appear at the scheduled time without notice is considered a no-show.

    • No refunds or vouchers will be provided.

4. Rescheduling Policy

  1. Client Rescheduling Requests (14 to 7 Days Before)

    • If the client requests a new date within this window, the deposit is converted into a voucher.

    • The voucher can be used later but cannot be refunded.

  2. Client Rescheduling Requests (Within the Last 7 Days)

    • Rescheduling requests inside the final 7 days follow the cancellation rules.

    • The deposit remains non-refundable.

  3. Same-Day Time Change (Up to 24 Hours Before the Session)

    • Clients may request a time change on the same day (earlier or later).

    • Must be requested up to 24 hours before the scheduled session.

    • Time adjustments depend on photographer availability.

    • The photographer must be notified directly.

5. Weather & Outdoor Conditions

  1. Outdoor sessions are affected by weather; however, light rain, cold weather, cloudiness, or wind do not automatically cancel a session.

  2. The photographer has full discretion to determine whether the weather is suitable for a photoshoot.

  3. If the photographer decides that weather conditions are not appropriate or safe, the session will be converted into an open-date voucher, which can be used at any future available date.

  4. Vouchers issued due to weather conditions are non-refundable.

6. Vouchers

  1. Vouchers issued for rescheduling or weather-related cancellations are:

    • Non-refundable

    • Transferable only with photographer approval

    • Valid until a new mutually agreed session date is arranged

  2. The monetary value cannot be exchanged for cash.

7. Client Responsibilities

  1. The client is responsible for arriving on time.

  2. Delays shorten the remaining session time; additional time is not guaranteed.

  3. Locations requiring entry fees (gardens, towers, private venues) must be paid by the client unless otherwise specified.

8. Photographer Rights

  1. The photographer reserves the right to end a session early if:

    • The environment is unsafe,

    • The client behaves abusively or uncooperatively,

    • Weather becomes dangerous.

  2. The photographer has creative control during the session regarding poses, light, angles, and workflow.

  3. The photographer may refuse any booking that conflicts with schedule or policies.

9. Image Delivery & Editing

  1. Edited images are delivered digitally via an online gallery.

  2. Delivery time varies depending on the season but is usually stated during booking.

  3. Raw/unedited images are not provided unless otherwise agreed.

  4. Clients may request additional edits at extra cost.

10. Image Rights & Usage

  1. Clients may use delivered photos for personal use, printing, and social media.

  2. Commercial use requires permission or licensing.

  3. The photographer may use images for portfolio and promotional purposes unless the client requests otherwise before the session.

11. Privacy & Data Protection

  • Personal data (names, emails, phone numbers, photos) are handled securely and never shared with third parties except for processing payments or delivering digital files.

12. Governing Law

  • All services are considered performed in Prague, Czech Republic.

  • These Terms & Conditions are governed by the laws of the Czech Republic.

  • Any disputes will be handled under Czech jurisdiction.
